The Party Wall etc. Act 1996, in plain English.

The Act applies in England and Wales. It provides a framework for particular work to party structures, new walls at the boundary and qualifying excavation near neighbouring structures.

Section 1 — line of junction

Covers specified new wall and boundary-line situations. A wall astride the boundary needs adjoining-owner consent.

Section 2 — party structures

Provides rights for defined work to existing party walls and party structures, supported by the section 3 notice process.

Section 6 — nearby excavation

Applies within three metres where excavation goes below the neighbour’s foundations, and within six metres where the statutory 45-degree test is met.
